Legal Deletion Request
Version 1.0
Effective date: [EFFECTIVE DATE]
This page explains how the owner of a sealed Capsule can ask for its permanent deletion under data protection law, which information a request needs, how ownership is verified and what happens after a request is made. It also explains how this process differs from deleting your own Capsule, and how orders of public authorities and matters concerning a Capsule Owner who has died or lost legal capacity are handled.
1. About This Page
1.1. What a Legal Deletion Request is. A Legal Deletion Request is a request by a Capsule Owner for the permanent deletion of their Capsule that is assessed under the grounds and exceptions available under applicable data protection law and other mandatory legal requirements. Depending on the law that applies to you, the rights concerned may include the right to have your personal data erased under the GDPR or the UK GDPR, or the right to request the erasure or destruction of your personal data under Law No. 6698 on the Protection of Personal Data of Türkiye.
1.2. Which Capsules it covers. A Legal Deletion Request concerns a sealed Capsule, that is, a Capsule that has received a Capsule number after its payment was confirmed and its Content passed automated review. This includes a Capsule whose Collection has opened and a Capsule in the Archive. A Capsule that has never been sealed has no Capsule number and cannot be the subject of a Legal Deletion Request. Section 8.3 explains how to make other requests about your personal data.
1.3. Relationship with the Terms of Service. This page explains in more detail the Legal Deletion Request process set out in the Terms of Service. Words such as "Platform", "Capsule", "Capsule Owner", "Content", "Collection", "Opening Date", "Archive", "sealed", "primary email address", "Report" and "Legal Deletion Request" have the meanings given in the Terms of Service. "AenVault", "we" and "us" mean the operator named on the Platform's Legal Notice page. If anything on this page appears to differ from the Terms of Service, the Terms of Service apply.
1.4. Mandatory rights. Nothing on this page limits any right you have under applicable data protection law or other law that cannot be waived or limited by contract. In particular, nothing on this page prevents you from complaining to a data protection authority or bringing proceedings before a court.
2. Who Can Make a Request and Which Channel to Use
2.1. Capsule Owners. A Legal Deletion Request can be made only by the Capsule Owner, for their own Capsule. How ownership is verified depends on whether your account still exists:
| Your situation | How to make a request | Section |
|---|---|---|
| Your account is active and you can sign in | Channel A: the Legal Deletion Request screen in your account | 4 |
| Your account has been deleted | Channel B: the form on this page, available without signing in | 5 |
| Ownership cannot be verified through Channel A or Channel B, for example because you can no longer sign in to an account that has not been deleted | Contact us as described in Section 8.1 | 8.1 |
2.2. People who are not the Capsule Owner. If you are not the Capsule Owner, you cannot use Channel A or Channel B. Section 8.2 explains what you can do if an opened Capsule contains information about you or infringes your rights. Section 9 explains how orders of courts and public authorities and notarised notices are handled, and Section 10 covers a Capsule Owner who has died or lost legal capacity.
3. Legal Deletion Request or Deleting Your Own Capsule
3.1. Deleting your own Capsule. While your account is active, you can also delete any of your Capsules yourself from the "My Capsules" page, including after it has opened. You must be signed in, enter a one-time code sent to your primary email address and type "DELETE" to confirm. The deletion takes place 14 days after your request, and you can cancel it until then. While a Report about the Capsule is being handled, or while the Capsule is subject to an official order or request, the deletion waits and takes place once that process has ended. The Terms of Service set out this process in full.
3.2. How a Legal Deletion Request differs. A Legal Deletion Request is a separate process. It is assessed under the grounds and exceptions available under applicable data protection law and other mandatory legal requirements, the final decision is made by a person (Section 6.2), and it can be used even after your account has been deleted. The 14-day waiting period that applies when you delete your own Capsule does not apply to it.
3.3. After your account has been deleted. If you chose to keep your Capsules when you deleted your account, the "My Capsules" page is no longer available to you, and your Capsules stay in their Collections. A Legal Deletion Request through Channel B is then the way to ask for the permanent deletion of one of them.
3.4. Separate processes. A Report, a payment dispute (chargeback), a Legal Deletion Request and the deletion of your own Capsule or account are four separate processes. The outcome of one does not decide the outcome of another.
4. Channel A: Making a Request From Your Account
4.1. When to use it. Use Channel A if your account is active and you can sign in.
4.2. What you need. You need to be signed in to the account in which the Capsule is recorded, and you need the Capsule number.
4.3. How to make the request.
- Sign in to your account.
- Open the Legal Deletion Request screen.
- Enter the Capsule number and submit the request.
4.4. What we check. We check that the Capsule is recorded in your account and that the Capsule number you entered is correct.
4.5. Finding the Capsule number. The Capsule number is shown in your account dashboard and in the purchase confirmation email sent when the Capsule was sealed.
5. Channel B: Making a Request Without Signing In
5.1. When to use it. Use Channel B if your account has been deleted. The form is on this page and can be used without signing in. It does not require an account and does not create one.
5.2. Which Capsules it covers. Channel B can be used only for a Capsule that has been sealed. When a Capsule is sealed, a record of the email address of the account at that moment is kept with it, and Channel B verifies ownership against that record. A Capsule that was never sealed has no Capsule number and no such record, and it cannot be the subject of a request through Channel B.
5.3. What you need.
- The email address of your account at the moment the Capsule was sealed. This is the primary email address your account had at that time, to which the purchase confirmation for the Capsule was also sent.
- The Capsule number.
- Access to that email address, because a verification code is sent to it.
If you no longer have access to that email address, Channel B cannot verify your ownership. Section 8.1 explains what you can do.
5.4. How to make the request.
- Enter the email address and the Capsule number in the form.
- If they match the record kept for that Capsule, we send a one-time verification code to that email address. A code is sent only if they match.
- Enter the code in the form to complete the verification of your ownership.
5.5. The verification code.
- The code is generated and checked on our servers.
- It can be used only once and is valid for a short time only. The email that contains the code tells you how long it is valid.
- A code becomes invalid after a limited number of incorrect entries.
- The number of requests and of verification attempts that can be made from the same source is limited over time. These limits protect the Platform against abuse and automated attempts.
If a code has expired or has become invalid, you can start again, subject to these limits.
5.6. What the code does and does not do. Entering the code correctly shows that you currently have access to the email address. Together with the Capsule number, this is the proof of ownership for the request. The code is used only for this ownership verification. It is not two-factor authentication, it is not used for signing in or account recovery, and it does not create an account or give access to any Content. Entering the code does not delete the Capsule (Section 6.1).
5.7. Personal data used. For Channel B, we process the email address and Capsule number you enter, the code, the attempts made to enter it and your IP address. The Privacy Policy explains how this data is used and how long it is kept.
6. After a Request Is Made
This Section applies to requests made through Channel A and Channel B.
6.1. No automatic deletion. Completing ownership verification does not delete the Capsule. The request is then reviewed as described in Section 6.2.
6.2. Decision by a person. Every request is reviewed by a human administrator, who makes the final decision. The request is assessed on the grounds and exceptions available under applicable data protection law and other mandatory legal requirements. If we cannot comply with your request in full, we tell you why.
6.3. Emails. You receive an email when your request is received and another about its outcome.
6.4. Official proceedings. While a request or proceedings of a court, prosecutor or other public authority concerning the Capsule are pending, the Capsule is not permanently deleted. If your request is approved, the deletion takes place once the request or proceedings have ended.
6.5. Records. Your request and its outcome are recorded in our administrative records. The Privacy Policy explains these records.
6.6. Your rights and time limits. Your rights under applicable data protection law, including the time limits within which requests must be answered, are explained in the Privacy Policy.
7. If a Request Is Approved
7.1. Permanent removal. The Capsule and its Content, including the message text and any photograph, are permanently removed and cannot be restored. The Capsule number is kept and is never assigned to another Capsule.
7.2. The Capsule's page. The page of the Capsule shows that the content has been removed. It does not give the reason for the removal.
7.3. Copies made by others. If the Capsule's Collection had already opened, others may have copied or shared its Content while it was public. AenVault cannot control or remove such copies, and the removal of the Capsule does not extend to them.
7.4. Records and backup copies. A record of the Capsule, which does not contain its Content, and the related payment records are kept. Copies of deleted data may remain in encrypted backup copies made before the removal. The Privacy Policy explains what is kept and why.
7.5. No refund. No refund is made when a Capsule is removed following a Legal Deletion Request, unless applicable law requires otherwise. The Refund Policy sets out when refunds are made.
8. Requests Outside Channels A and B
8.1. If ownership cannot be verified through either channel. If ownership cannot be verified through Channel A or Channel B, for example because you can no longer sign in to an account that has not been deleted, or because you no longer have access to the email address recorded when the Capsule was sealed, you can still exercise your data protection rights by contacting us using the details on the Legal Notice page. Such requests are handled under the Privacy Policy and applicable law, separately from account access and from Channels A and B. The Terms of Service also explain how you can verify that a Capsule is yours if you have lost access to the email address of your account.
8.2. If you appear in a Capsule or it infringes your rights. If an opened Capsule contains personal data about you, you can report it under the topic "personal information or photo", or contact us using the details on the Legal Notice page to exercise your rights under data protection law. If you believe that Content infringes your rights, you can make a Report about a rights violation. The Content Disputes page explains how to make a Report.
8.3. Other requests about your personal data. Requests about personal data that is not in a sealed Capsule, including Content that you saved but did not pay for, are handled as described in the Privacy Policy.
9. Orders of Courts and Public Authorities, and Notarised Notices
9.1. How they are sent. Orders and requests from courts, prosecutors, law enforcement bodies and similar public authorities, and notarised notices of rights ownership or copyright infringement, are not made through Channel A or Channel B. They can be sent using the contact details on the Legal Notice page.
9.2. Direct assessment. Such an order, request or notice is assessed directly by a human administrator, without the ownership verification steps of Channels A and B.
9.3. Orders. A Capsule, including one whose Collection has opened or one in the Archive, is removed where a lawful order from a competent court, prosecutor, law enforcement body or similar public authority, or another mandatory legal requirement, applies.
9.4. Notarised notices. A notarised notice of rights ownership or copyright infringement is not an order of a court or public authority, and it does not by itself require removal. It may lead to removal only if the administrator decides after review that removal is justified.
9.5. Effect. If a Capsule is removed under this Section, Sections 7.1 to 7.5 apply in the same way.
10. Death or Loss of Legal Capacity of a Capsule Owner
10.1. No early access. The death or loss of legal capacity of a Capsule Owner does not give heirs, guardians, representatives or any other person a right to open a Capsule before the Opening Date of its Collection.
10.2. Official documents. If an heir, guardian or other person submits official documents, such as a certificate of inheritance or a guardianship decision, a human administrator reviews them as a separate matter, under the process for official orders and requests described in Section 9. Documents can be sent using the contact details on the Legal Notice page. Submitting documents does not by itself create a right of early access.
10.3. Requests to delete. Whether an heir, guardian or other representative can make a Legal Deletion Request on behalf of a Capsule Owner who has died or lost legal capacity depends on the law that applies.
